H1B 2018 – Approval and RFE breakup for WAC181915 – May 29 2018 cases

In continuation with the previous WAC182005**** analysis we are publishing the data for WAC181915**** , most of these cases were filed on May 29, 2018 and hence crossed the 15 calendar day deadline for Premium processing and should give a good idea of Approval and RFE rates in the initial days.

Total number of I-129 (H1B extension, amendments, consular) cases filed on 05/29/2018 (May 29 2018) – 1211

Here is the latest update with all of the WAC18195**** data. Total H1B cases – 1211. Data shows around 26% overall probability of getting RFE.

Below is the breakup case status as of today.

377 cases are already approved.
702  show the receipt is sent.
132  cases they have RFE issued.

Pending cases Split up

695 (186+377+132) cases filed in premium.
516 cases in regular mode.

186 premium cases show a status of pending for action.

If you include the Approved and RFE cases as premium total of 695 cases were filed in premium.

Inferences

  • More than 50% of cases are being filed in premium.
  • Rate of RFE seems around 26% it has increased with the receipt number sequence increasing. Possibly more RFE if USCIS is not able to evaluate a case?

Analysis of H1B cases filed on June 13 ,14 2018 – WAC182005*** Series

We analysed several thousand petition numbers to identify around 1285 petitions filed on USCIS work day 200 for Fiscal Year 2017-18. All the cases analysed start with WAC182005**** series.

Most of these cases have filed date of June 13 2018 or June 14 2018. Even though it is less than 1 week from filing we have seen quite a bit of action in these cases. It also demonstrates the volume being handled by California Center. Also note that we have not included I-539 (H4), Green card, I-140 or any other petition type in the below numbers.

This data is accurate as of 06/20/2018 but I will keep updating the stats on a daily basis, to give an idea to prospective H1B holders.

As of 06/20/2018 (WAC182005)

174 cases are already approved.
1092 show the receipt is sent.
19 cases they have RFE issued.

Pending cases Split up

490 cases filed in premium.
602 cases in regular.

If you include the Approved and RFE cases as premium total of 683 cases were filed in premium.

Inferences

  • More than 50% of cases are being filed in premium.
  • Also the Rate of RFE is much lower than what we have seen in the recent past. This might change as we near 15 day premium processing deadline.

Donald Trump to Announce H1B, Immigration reforms on Wednesday Jan 24 2017

With Trump keeping his promises with respect to other key issues like Trans Pacific partnership and Affordable Care Act, the focus is now on Immigration and H1B.

The news from Trump’s office is  President Trump will announce key H1B and Immigration reforms. He is likely to add stringent conditions to H1B process and possible taxes on misuse.

Yesterday USCIS (US Immigration Services – Organisation dealing with VISA) increased filing fees across the board for various non immigrant and immigrant applications.

Possible bad news for DREAMERS and potentials immigrants from Middle Eastern Countries are also expected.

Some Good News

There is a possibility of good news for immigrants who are on waiting list for Green Card, as Trump had promised a delegation Indian Emissaries on increasing removing cap for Immigrant applications for India and China. If this cap is lifted it will pave way for several H1B holders to become Green Card holders and eventually citizens.

Currently waiting list is very high and Indian immigrants who applied for Green Card on or before 2005 are receiving their Green Card in 2017. This will also reduce H1B abuse by eliminating this VISA for these folks.

Business Impact

Outsourcing companies are expected to be worst affected due to H1B reform with the change in Fee or salary structure expected to affect margins directly. Indian and Chines companies will be watching Wednesday’s developments closely.

In near term companies in USA will also be impacted by sudden shortage of skilled or experience resources if the rule changes cause mass exodus of employees in Non Immigrant VISAs.
